Didn't see this one coming after that multi-million lawsuit with crash involving comedian Tracey Morgan.

The Walmart driver Kevin Roper, had driven his POV for like 12 hours coming back from home time, then jumped in his truck with no rest. He was also charged with first degree aggravated manslaughter, vehicular homicide, and eight counts of aggravated assault in varying degrees by a Middlesex County, New Jersey grand jury.

This driver might be looking at a prison cell for a good part of his life, as well as never driving a truck again.

He took a plea deal, were if he is not arrested for 3 years and he completes 300 hours of community service his record will be expunged. Per CNN news article.

Totally lucked out. This could have had him behind bars for quite awhile. Wonder what the suspended sentence was, that he gets to serve if he screws up?

Thanks for the heads up - I couldn't find what his final outcome was on a brief search.

Walmart Driver Plea Deal

Walmart settled with all plaintiffs out of court from what I understand. Probably cost millions and millions. 10 million for the guy who died kids. Undisclosed amount for Morgan.

So if this guy gets the charges dropped (no conviction), wonder if he can get his CDL back? Didn't see anything in the deal that prohibits him driving - and he wasn't intoxicated - just fatigued.

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

Doesn't much matter that everything is cleared after 3 years of behaving. No company will touch him after this. More to the point, no company's insurance will touch him. He will probably never drive professionally again.
