I have a felony evading arrest in a motor vehicle. From 2003 will this disqualify me for hire if I get my cdl . Thanks

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

What was the FINAL DISPOSITION on the charge?

Did you get convicted? Do time? Get a license suspension?

It's old enough, that it might not present an issue - depending on what your criminal & driving record looks like SINCE THEN.

Any other charges? You got blue-lighted and ran - felony evading?

15 months is a long time for a first arrest running from. Tell me none of my business, if you don't want to say.

Absent anything else -clean criminal otherwise, clean driving record - a felony that old, you should be OK.

Start applying - DO DISCLOSE (they'll find it anyways) and see what happens.

If your first couple of choices reject for it - then there's "second chance companies" that are willing to overlook old history.

But I think this one is old enough - and absent some other extensive criminal/driving history you're NOT SAYING - you should be OK.

Now...

THOSE might present an issue.

Why would you only mention a 14 year old evading - and not mention 78 months on a 2nd conviction for Firearms/Convicted Felon?

Which means you just recently were released.

Welcome back to the world of the free.

You are going to have to start looking at the "second chance companies" - and I honestly can't tell you what your chances are with so many serious felonies, including the more recent firearms ones.

You aren't likely to get a HM endorsement or TWIC card - and you won't be able to travel into Canada either.

We have a page here that list companies that hire convicted felons, that you can reference as a starting point.

I found an article on another site, that references a number of companies by how long since conviction they will consider a hire. You can look at these as a possibility also.

Many of them do provide training so you can get your CDL. I WOULD NOT GO TO A PRIVATE CDL SCHOOL - because you may end up paying/owing $$ for the school - but be UNABLE TO GET A JOB because of your criminal history.

NONE of the offenses you've disclosed would disqualify you from GETTING A CDL under FMSCA regs (or the one that might - the driving offense, has already passed any potential disqualification period).

Not going to lie - you've got an uphill road ahead.

Fm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

TWIC:

Transportation Worker Identification Credential

Truck drivers who regularly pick up from or deliver to the shipping ports will often be required to carry a TWIC card.

Your TWIC is a tamper-resistant biometric card which acts as both your identification in secure areas, as well as an indicator of you having passed the necessary security clearance. TWIC cards are valid for five years. The issuance of TWIC cards is overseen by the Transportation Security Administration and the Department of Homeland Security.

HOS refers to the logbook hours of service regulations.
