Improper Lane Change To A Turn Signal 2 Point?

So I need some help I had an improper lane change charge and I was offered a turn signal to point reduction in charge. Is this a good deal? Will I be able to get a better job with this reduction? Please help thank you

Hey Jeff. I can't pretend to be a lawyer of course so I can't give you a solid answer as far as whether or not to accept a plea. But generally speaking, most drivers look to get a plea where they pay a fine but don't get any points on their license. If you can get something like that you're probably being offered about the best deal you can hope for. But we always recommend that people hire an attorney to protect their licenses. That's all you've got as a truck driver so you have to do all you can to protect it.

Thank you Brett for your reply. I appreciate your site and response. I just joined but this site has truly helped me. I just became a truck driver last April and I use this site for reference pretty much whenever have a question about the trucking industry. So thank you so much for what you created it has assisted me in my family. Unfortunately I did get cited for improper lane change involving an accident and went to court yesterday they dropped it down to a turn signal violation. And it's also in a court district that does not like truck drivers and never drop the charges down. But they did for me for some reason I did have legal representation through drivers legal Plan.

I was going to ask for some more detail on your citation - which you gave in your response.

It did occur in a CMV , and and there was also an accident involved.

Was it a DOT Reportable Accident? IE: any vehicle involved sustained sufficient damage that required it to be towed from the scene - and/or - someone was sufficiently injured to require being taken from the scene by ambulance?

Turn Signal Violation is ALWAYS going to be better than a lane change violation in a CMV - especially if it was incidental to an ACCIDENT.

Out of curiosity - which legal defense service do you subscribe to? We advise drivers here to take the plan if their company offers it, or consider subscribing to an "outside plan" if they don't. Looks like these guys showed up for you (where there are some complaints of services that don't do what you paid them to do), so I was wondering if you would share with us which one it was?

So yes - while getting the ticket DISMISSED COMPLETELY would have been the best outcome - getting it reduced from a more serious lane change offense, to an improper signal, was a good outcome.

CMV:

Commercial Motor Vehicle

A CMV is a vehicle that is used as part of a business, is involved in interstate commerce, and may fit any of these descriptions:

  • Weighs 10,001 pounds or more
  • Has a gross vehicle weight rating or gross combination weight rating of 10,001 pounds or more
  • Is designed or used to transport 16 or more passengers (including the driver) not for compensation
  • Is designed or used to transport 9 or more passengers (including the driver) for compensation
  • Is transporting hazardous materials in a quantity requiring placards
