In 2013 the FMCSA issued new hours-of-service rules, which in part required that commercial driver's 34-hour restarts needed to include two 1 a.m to 5 a.m. periods, and that 34-hour restarts could not be taken more than once in any period of 7 consecutive days. Both the trucking industry and Congress raised concerns about the new regs, most specifically regarding increased traffic congestion in the morning rush hour periods when truck drivers would finally be released back in to the wild after their 34-hour restart.
In late 2014, Congress suspended those provisions pending a study on whether or not the rules actually improved safety.
In a letter from the Department of Transportation's Office of Inspector General, the DOT informed Congress that a study conducted to identify whether the new rules resulted in any net safety benefit has concluded that the rules did not, in fact, improve operations, safety, fatigue, or health enough to justify keeping them.
"Chief arguments against the regulations were that it pushed drivers into early morning rush hour traffic — which caused safety and operational concerns — and that FMCSA issued the rule with little scientific evidence to back up the restrictions."
