Unfortunately there is no clear answer for this. To play it safe you should answer "yes". Obviously I see your point that if it was dismissed and it isn't on your record then why would you mention it? The problem is that nothing ever seems to actually disappear like they say it will. Everything is recorded somewhere, and these trucking companies always seem to find it.
Even arrest records that were supposedly expunged are still easily found by people who know how to find such things.
I remember being in an orientation class for a major carrier and the one guy got called into the office. He came back with this troubled look and said, "Man, that was a little creepy. They asked me why I didn't mention working at a certain place eight years ago and I told them I had never worked there. I went in for an interview but didn't get the job. How in the world did they find out about that?"
Admittedly that is a little creepy. But they have their ways.
I believe in the end the final determination will be made based upon what shows up on your driving record. So if your driving record is clean, that's what they'll go by. But if you tell a company you had no violations, and they find that speeding ticket, regardless of the final verdict they may determine you're the type to try to hide things and pass on you. If you're up front about it they'll take a closer look to determine the best course of action.
The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.
"Have you had any moving violations or traffic convictions in the past 3 Years?*"
That question is a little ambiguous. Typically - the question is "convictions for moving violations". The OR between VIOLATIONS OR CONVICTIONS - seems to ask whether you had any TICKETS OR CONVICTIONS.
The way the question as asked - the HONEST ANSWER would be YES - and in the details - DISMISSED.
Also keep in mind - TRAFFIC SCHOOL will no longer be an option once you have your CDL. It is against DOT Regs, to allow CDL Holders to avoid traffic convictions by attending Defensive Driving School. A judge may "withhold adjudication", but a driver may not "elect driving school".
Have you actually pulled a copy of your MVR to see if it's there or not? Typically - even these types of "discretionary dismissals" show up - though it may take a month or three for them to wind their way from the court to the DMV.
This is a tough one to answer - as far as if a YES OR NO - is the correct response on the application. The application process is as much a test of HONESTY, as it is an effort to "look for potential disqualifications" on the application itself.

A CDL is required to drive any of the following vehicles:
A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.
State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.
The state agency that handles everything related to your driver's licences, including testing, issuance, transfers, and revocation.
An MVR is a report of your driving history, as reported from your state Department of Motor Vehicles. Information on this report may include Drivers License information, point history, violations, convictions, and license status on your driving record.
Agreed honesty is what they are looking for. If you hide something now, will you not inform them of an accident on the road? Will you try to hide it?
Also, how many miles over the speed limit was this ticket? 15 mph is considered wreckless driving, dismissed or not, that will be a concern.
Brett and Rick Thanks for you Input. The question is ambiguous. The OR is what bothered me as well. There was no room for explanation in the online application and that would have made it easier. I didn't want want to be dishonest but didn't want to unnecessarily incriminate myself either.

Who was this for? Most companies use the "intelliapp.driverapponline" site - and they do give you a space to give details for accidents and citations. The questions may vary slightly from company to company - but the forms on the site have always given room for details.
BE HONEST and say you had a citation - if it doesn't give space for details - explain it to the recruiter when you are contacted.

That's our application. It's a "short form" application so companies can see if applicants meet their minimum qualifications before contacting them. They'll get all the details on the phone if need be.

I am filling out my application and it ask "Have you had any moving violations or traffic convictions in the past 3 Years?*" I was ticket for speeding in Jan but took defensive driving and it was dismissed. I know a driving record is very important for new driver. I am asking if I should answer NO since it was dismissed with drivers education. It is not on my record. Please weigh in?
