I failed a drug test and went to the assessment and was recommended for a SAP . I wasn't reliant on my CDL so I haven't attended the class. Is there a time limit in which that has to be done? And is there an amount of time that can pass where its possible after complete loss of cdl to get it back by re-testing without the recommended classes?

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

Substance Abuse Professional

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

How long have you held your CDL'A... (used or unused?)

It's SAP btw, IIRC.

Why would you compromise that 'gold card?'

I'll do without TV/Direct to pay our auto insurance, to protect my husband's CDL..

Not much help, I know. Just why just why. I won't even let him drive with a tail light out on his PV....

I'm sure you will hear from the veterans sometime soon...just IMHO.

I don't know how long you have to complete the class or if there's a time limit. Here is some information we have on the subject:

Maybe I am reading it wrong, but you don't seem to be taking the CDL seriously, the Las portion of your thread is going to make a lot of people think your lazy and not truly committed. I think before anything else you need to do so some serious soul searching about if this trucking thing is something you truly want to do

There's no "actual limit" for how long you can wait to do a SAP/Return To Duty Protocol. And failing a test doesn't revoke or suspend your CDL (which may vary from state to state), but likely no loss of license or CDL.

You WILL HOWEVER, not be able to work in a "safety sensitive position" (that is DRIVE A COMMERCIAL VEHICLE), until you HAVE COMPLETED SAP/Return To Duty Protocol.

So most folks who drive for a living, are going to get into A SAP ASAP (ASAP - see what I did there - LOL), so they can GET BACK TO WORK ASAP.

And if you were employed as a driver and got CUT LOOSE because of the failed test (and they MUST PULL YOU FROM THE ROAD for a failure) - it will be on your DAC , and possibly on FMCSA's Test Site (which is not yet fully implemented).

Failed tests are one of THE MOST DIFFICULT THINGS TO OVERCOME IN THIS INDUSTRY.

People who fail tests AT ORIENTATION (before getting their CDL, or coming in as "recent graduates" of a private school), ALMOST NEVER RECOVER and get on the road. Long time VALUED DRIVERS have a somewhat better chance of doing a SAP and getting back onboard with their companies. Newbies are usually just NOT WORTH TAKING THE RISK.

Also - popping hot for a "legally prescribed med", gives you a better shot at a return from a SAP - than "recreational drug use". And no matter what anyone says - even if weed were legalized federally for recreational use - there's VERY LITTLE CHANCE that "safety sensitive position" jobs (Commercial Drivers, Pilots, etc.) are going to be allowed to partake.

Best of luck to you. As far as Commercial Drivers go - DRUGS ARE BAD M'KAY...

SAP:

Substance Abuse Professional

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

Fm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

DAC:

Drive-A-Check Report

A truck drivers DAC report will contain detailed information about their job history of the last 10 years as a CDL driver (as required by the DOT).

It may also contain your criminal history, drug test results, DOT infractions and accident history. The program is strictly voluntary from a company standpoint, but most of the medium-to-large carriers will participate.

Most trucking companies use DAC reports as part of their hiring and background check process. It is extremely important that drivers verify that the information contained in it is correct, and have it fixed if it's not.

OOS:

When a violation by either a driver or company is confirmed, an out-of-service order removes either the driver or the vehicle from the roadway until the violation is corrected.
