Mercer Trailer Lease – What Happened After They Took My Trailer Back

I’ve been hesitant to post this, but after everything I’ve experienced, I feel like other drivers need to hear what happened — especially anyone considering a lease with Mercer.

A few years ago, I entered into a lease-purchase agreement for a flatbed trailer through Mercer Transportation. I hauled under their authority for several years and made consistent lease payments. Toward the end of the lease term, Mercer suddenly terminated my contract. They then refused to accept further payments, demanded I return the trailer, and eventually repossessed it.

I thought that would be the end of it. But instead, Mercer sued me — not just for the supposed remaining balance, but for the full trailer value, plus over $60,000 in alleged attorney’s fees, even though they had already repossessed the trailer.

To make it worse, they filed a judgment abstract in a Texas county where I didn’t even live, using a handwritten dollar amount that was never awarded by any court. I’ve been tied up in legal battles ever since.

I’m not sharing this to complain — I have the court records, the lease agreement, and all the documents to back this up. I’ve now filed a lawsuit of my own, challenging how Mercer handled all of this — not just the repossession, but the inflated judgment and what I believe were fraudulent and abusive tactics.

Recently, I did a search of online court records in Texas, and I found other cases where Mercer has sued drivers under very similar circumstances. This looks more and more like a pattern of abuse tied to their lease program, and I’m now trying to find others who may have been affected.
