He is 100% correct! A very hard and expensive lesson learned. Even though everything was specific in the contract and we would win in a court of law. It’s the time, hard work and mental stress that ultimately cost the most. It’s just not worth it!! Always always go with a reputable company, ALWAYS!!

That’s was tuff to admit but those are the facts.

For anyone just reading along for general information, this is yet another example of why we strongly advise to avoid two options: One is leasing, and the second is any 1099 company. The driver ends up with all the risk and little to show for it if things go sideways. It happens often, and when it does, it seldom ends well for the driver.

This was an expensive lesson that could have been avoided easily with a few questions posted on this site before jumping into the abyss.

She is correct! And we are returning the truck to their exact location specified.

Truth:

You must return the truck to their property of their choosing. Example.... If Prime tells you to take the truck to MO, but you drop it at the terminal in PA.. it can still be an abandonment on your DAC. Why? Because they process trucks out of the MO terminal and assign them/sell them there. Any truck turned in at a different terminal then needs to be transported back to MO. Meaning they have to pay a driver to get it and may be paying for rental cars or hotels for that driver also.

Return the truck to the exact property which you were told, not any property they own.

And yes we have already been hired by a company (reputable one) but again having a problem getting back home before starting orientation with new company. Because we haven’t been paid.

Can’t just drive this truck home and abandon it, because that will go against us. So I’m trying my best to figure out how to Legally get Out of this situation

1099 is something we strongly advise against. Contractual violations are civil matters... Lawsuits. Money. Attorneys. Good luck.

Change companies ASAP. Most are looking for good teams however you did have suspension problems originally and changing companies may bring those back up. How has your record been since CRE?

Hi thank you for your response- no no problems we were just trying to venture out to get a glimpse into OO and since the company was offering to pay revenue we thought it might be a good way to learn without taking 100% risk.

Guess we learned alright. Our record is excellent we’ve been driving for almost 2 years now.

Just made a huge mistake clearly. I find it extremely difficult to believe that there aren’t any protections in place for something like this.

Any recourse for not getting paid if 1099

Hello everyone!! So I did this stupid thing and trusted a company. Please try not to beat me up too bad. Started working for Artia/KDM United Trucking 3 weeks ago and have run about 18k miles for them but have only gotten paid once. I am supposed to be paid very Friday per contract. The keeps stringing me along telling me “accounting is figuring things out”. I’m stuck in his truck with no money and no way to get home. Is there anything I can do? Please?

So I just wanted to reach out and thank you all for the advice and direction given!! I happy to report my fiancĂ© and I are currently in route, as I type this, to Salt Lake City for training with CR England!! We are so excited to learn and get going on the road! 😊

Man, that sux, Karla . . . put your eggs in a basket upon word, and then they renege. Kind of one of the reasons the veterans of this site always remind us to get EVERYTHING in writing / email.

Trans Am has 'NO' training anymore, so nix that. . . have you tried Western Express? CRST? (I know, teaming for a year or so, but... still...) And lastly, there's a 2nd chance company here in Ohio, that may take a chance. Look up Marc Lee's diaries on them: Dutch Maid Logistics. All I have in the moment; I sure feel for you, girl.

Suspensions on driving record

Thank you all for the information it was very helpful!! However now I’ve run into yet another problem!!

I applied to all company sponsored programs for obtaining CDL- May Trucking gave me a pre-hire letter but said I had to go to school on my own. Schneider gave a pre-hire letter but said the same thing as May.

Then Driver- Solutions contact me (Pam International) back in July and said I would be able to attend their CDL program in October 2020 (now) because that’s when my license will have been re-Instated for a year. My license was suspended in October 2019 for about 3 weeks (for non-payment of court fees) then again in Feb 2020 for about a week again for the same thing. So technically it would be March 2021 for a full year of no suspensions. However the driver Solutions recruiter said that due to the short length of the suspension and reason of the suspension she could get that suspension “WAVED” and get me in school this month. So she went through her “higher ups” and got the “waiver approved” so I was SCHEDULED for school on October 26, 2020 (next week) then I got a phone call today from the recruiter saying “Pam won’t hire you so we can’t get you unto school”.

I’m sure you can imagine my surprise and I asked “why” the recruiter said “they didn’t tell me why”.

So here I am jobless, no CDL (I did go ahead and obtain my CDL Permit on my own) and I’m homeless to top it all off!!! All because I trusted and listened to this recruiter for 3 months!!!

PLEASE PLEASE PLEASE HELP!!! Can anyone give me any suggestions!! I am so devastated right now!! Thank you so much in advance 🙏🙏🙏

Hi all! I’m new here....currently in the process of obtaining my CDL-A, but I am running into a road block. I have a few suspensions on my driving record. ALL of them are due to not paying small traffic fines (nothing criminal or even speeding) within a timely manner. A couple of the suspensions are only for a week or two (shows date suspended and re-instated on driving record) when I was without knowledge my license was even suspended, when I found out I paid to have re-instated immediately. All that said, is there anyone out there that will hire me due to my suspensions? Thank you 😊
