Which companies go by the charge date and "NOT" the conviction date?????

hello, this has been puzzling me for the past month now..i have a "under the influence of a controlled substance charge that will be 5 years old next year, BUT, the conviction date was 11/14/2013. the reason beung i was not issued a citiation for court date nor was a warrant issued so he just lingered there. so recently i decided to get back into the trucking industry so i checked my record and lo and behiold..'THERE SHE WAS!!!.. this is disturbing! im attending classes for a dumb mistake i made 5 years ago..(Misdemeanor) so im jsut curios and desperate.which comapnies go by the charge date and not the conviction date??
