It just seems after reading the article and the comments; driver and dm had butted heads in the past. Driver informs dm hey I'm going home I "hurt" myself today....instead of getting company physical/exam he chose to circumvent ,posible, company injury policies, wether or not it was because of his indiscretions that may have caused the injury. He decided to park his truck and take off work without proper notice and sought out his own doctor who medicated him. Company man got ****ed labeled drivers act as "abandonment". I see that it was, a shifty lawyer saw an avenue to make a buck.....welcome to the real world.....

Obviously we will never know all the details about what happened in this situation. What we do know is that Prime was slapped on the wrist with what turned out to be about a $20,000.00 judgement. It doesn't mean Prime is a bad company or that the driver was a bad driver. People aren't perfect, someone from Prime just put information on the drivers DAC report that OSHA felt was retaliatory. I wouldn't want to be the Prime employee responsible for that.

Drive-A-Check Report
A truck drivers DAC report will contain detailed information about their job history of the last 10 years as a CDL driver (as required by the DOT).
It may also contain your criminal history, drug test results, DOT infractions and accident history. The program is strictly voluntary from a company standpoint, but most of the medium-to-large carriers will participate.
Most trucking companies use DAC reports as part of their hiring and background check process. It is extremely important that drivers verify that the information contained in it is correct, and have it fixed if it's not.
