Swift Screwed Me!!!

Hello All,

I have an issue that started the Friday before the last week of January 2025. After receiving my DOT Medical card, CDL permit and was in the driving range and road with instructor. I was advised by Swift that because of a sleep study that was done over 14 years ago saying it was recommended that I wear a CPAP mask. They Disqualified me from the program before one week before graduation. If this was a problem to begin with, then they should have said so, before wasting my time. My question, if I have my CDL permit and DOT medical card. Do I have any options to continue my training without the sleep study bull****?

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

CPAP:

Constant Positive Airway Pressure

CPAP is a breathing assist device which is worn over the mouth or nose. It provides nighttime relief for individuals who suffer from Sleep Apnea.

Well they probably just want to make sure you don’t asphyxiate in your sleep while out on the road. I’m not a lawyer though, so I couldn’t tell you if that constitutes discrimination. I guess if someone has epilepsy and refuses to take prescription meds for it, that would pose a significant safety risk. Diabetics not having a diabetes waiver or insulin might be an even more common example.

Swift didn't screw you. You have a probable diagnosed medical condition that you most likely neglected to disclose in your medical exam, which i believe invalidates your medical card. This non disclosure is viewed by Swift as a "lied on application materials." The non treatment of a diagnosed condition would hand the injured parties attorney the means to get "F@#$ YOU!" money awarded by a jury.
