OK this is the second time this week we happen to be talking about a near or an accident. OMG. Apparently the driver admitted to being up 24 hours without sleep. Wtf? And then he drives?
He will get a bunch of charges through at him in the end and frankly speaking I hope they give him the max amount of time on every single charge and run each sentence consecutive. It's people like this that are give the rest of us a bad image and because of this it cancels out any argument that we can make saying we don't need more regulations.
I know no one way control someone's off duty/sleeper berth time but damn it this just make me see red. Safety regulations are in place for a reason and who is this dirt bag to think that he is safe to drive without sleep in 24 hours? Now he is putting the focus right back on trucking.
I am serious upset over this. Why some might ask. Because I can come to work for 16 years and do everything by the book and not have one accident and yet because I drive a truck i get looked at by the general public like I was behind the wheel and hit that van.
OK maybe I am being a bit over rot or irrational but the more we try to do the right thing ONE.......JUST ONE piece of human waste comes along and sets us back 10 years. I am done with this idiot. Since his actions cause lose of life then his sentence should match the end result of his action. Issue the death sentence cause its the only way to fix stupid.
Parking lot accidents happen. Backing accidents happen. Slow moving contact accidents happen. But by God accidents like this one should not happen.
He might of been scared to loose his job if he told Walmart he had not been sleeping but at least he would not have been driving and injured AND killed someone. The guy did not have the balls to stand up and take responsibility and tell his company he was not fit to drive. Now the New Jersey tax payers have to pay to keep this guy behind bars.
As I have said once before and I will say it again WE, the drivers out on the road, are our own worst enemy out here and have no one to blame but ourselves for the regulations that will be coming in the future. We have spent the last 70 years of modern trucking trying to get by and failed our brothers and sisters out here on the road by not policing ourselves. Now it's time to pay the piper and we don't like it.
At worse this guy will get charged with vehicular manslaughter. What they should be charging this guy with is ...."Willfully disregarding a federal mandated safety sleep time by not getting proper rest before returning to work therefore knowingly jeopardizing the safety of everyone on the road"......to me it does not sound like there is a very big leap to murder in this case.
Even though almost everything I have stated is true I am really just blowing off some steam. This seriously has me angry. I seriously don't care why he did not get any sleep in the last 24 hours. It should not matter. He did the crime now he has to do the time. Just push him off of a 110 story building and call it a day.

That driver was on Elogs but Elogs can't make you sleep and get your rest. They only track what you are supposed to be doing. Like sleeping. But if you go on the sleeper berth line and then get out of the truck and go do whatever then it's your fault. Not Elogs.
I Don't know how you can call Walmart a trash corporation when they have a business model and they follow it and they do it very well. I know I know the first thing people yell is about the wages they pay....well for anyone that might not know it they do pay over minimum wage though just barely but here is the thing. Minimum wage is not made to make a living on. It's to get you started and you move on from there and get a better job. You educate yourself and learn what you can and move up the minimum wage ladder. If someone is satisfied with staying at the bottom then that is on them. Can't blame an entity for providing a service that EVERYONE wants. If they weren't wanted then people would not be knocking their doors down to shop there.
