I see Freight Right is forbidden to take any retaliatory actions against him when he's working for them again. Yeah, I bet he gets plenty miles and only the best loads....NOT. If I were him I would seek employment elsewhere.

I would venture to say - as long as it takes for these cases to finally conclude, that this guy is already working elsewhere - though whether it is behind the wheel would be difficult to say.
There's usually more to these cases than meets the eye - such as performance issues in the past, etc. But once a company tries to force a driver to operate in "unsafe conditions" (or violate the law), they leave themselves open to complaints, suits and settlements such as this.
You can be pretty sure this company won't be throwing the driver a welcome back party - and any appearance of retaliation is going to land them in hot water again. Unless he got blacklisted for the initial firing - he'd probably be better off going elsewhere. Either way - they still have to be listed as a reference, and would still get the opportunity to screw him over in the future.
