If it is posted at 8 tons, and you weigh less empty, should be completely legal.
Make sure via a CAT Scale what the actual empty weight is, though.
A network of over 1,500 certified truck scales across the U.S. and Canada found primarily at truck stops. CAT scales are by far the most trustworthy scales out there.
In fact, CAT Scale offers an unconditional Guarantee:
“If you get an overweight fine from the state after our scale showed your legal, we will immediately check our scale. If our scale is wrong, we will reimburse you for the fine. If our scale is correct, a representative of CAT Scale Company will appear in court with the driver as a witness”

I work for a company in Pittsburgh, PA...
When leaving our warehouse and heading into the city the shortest route has a street which is posted with an 8 ton weight limit.
Most of the company's straight trucks are under CDL weight (25,500 gvw) and are 14,500 empty. After finishing all deliveries, could these trucks legally use this street to return to the warehouse?
When I took my CDL test I asked the instructor this question. He said that it depends on what kind of mood the authorities are in. I have heard that the weight limit is based on GVW, and also that it is based on actual weight. Does anybody know what the correct answer is?
