Failed Drug Test/ Pending DUI

Hi, I hope everyone is doing well. I figured I could use some advice right now on what exactly I'm dealing with my CDL. Basically, what happened last year around October or November I had been using CBD Gummies I bought them over the counter legally but didn't realize they would show up on a drug test. I had taken several drug tests prior to that test and they never showed up but anyway, this time I got flagged for pot. So now I'm on like step 5 of looking for a SAP company to sponsor me so I can take my drug tests. As if that wasn't enough I also got a pending DUI sitting on me right now from around the same time last year. Not sure what exactly I should do at this point. I have Driver's legal plan and have contacted an attorney to try and represent me coming up in March of this year. I guess I'm like in limbo right now b/c Idk how to handle any of this. I will say that I definitely learned my lesson from all this. I have been out of the truck for over 6 months now. Last time I drove was July of 2023 after I ended up getting terminated from my company b/c they tried saying I had an inspection level 3 that wasn't reported. Not sure where to go from here. Like I said I haven't even tried applying to any other companies b/c with the pending DUI pretty sure I would just end up signing on and then getting terminated anyway a few months later if I was lucky enough to even get signed on. I don't see the charges on my DAC report yet but I think there sitting on my MVR. My CDL is still valid for a few years and my medical certificate is valid for a few years as well. Any advice on how to handle all this would be much appreciated. Thanks

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

SAP:

Substance Abuse Professional

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

MVR:

Motor Vehicle Record

An MVR is a report of your driving history, as reported from your state Department of Motor Vehicles. Information on this report may include Drivers License information, point history, violations, convictions, and license status on your driving record.

DAC:

Drive-A-Check Report

A truck drivers DAC report will contain detailed information about their job history of the last 10 years as a CDL driver (as required by the DOT).

It may also contain your criminal history, drug test results, DOT infractions and accident history. The program is strictly voluntary from a company standpoint, but most of the medium-to-large carriers will participate.

Most trucking companies use DAC reports as part of their hiring and background check process. It is extremely important that drivers verify that the information contained in it is correct, and have it fixed if it's not.

Right now with the job market and you're showing a complete lack of judgement (X2), I am nearly certain no company will hire you. For them, their customers, and their insurance underwriters you are to be seen as the next lawsuit all over the evening News.

Drug results for use and a DUI are not what any employer, in any field, are in search of.

I hope you obtain some professional help.

Are you for real??! How long did you drive before you got terminated?

Don't count on getting hired anytime soon until you get that DUI taken care of. If those lawyers can get it changed from a DUI to something else, you will be very fortunate and you might have a chance. However, the economy has tanked and it doesn't look like it's going to recover anytime soon.

You are poison with those two incidents and your termination for not turning in your level III paperwork. I have been inspected many times and everyone of the inspectors told me to get my paperwork turned into the office immediately because they have to acknowledge it. It didn't matter if you had write-ups on it or if you had a clean inspection, your company is to be informed.

For now, don't even think about going back to work as a driver until you get that DUI taken care of. As for going to a company so you can finish off the SAP program, you're not going to find anyone in this economy to take you on. There are far too many good drivers with nothing on their records looking for work and struggling to get hired.

Your medical card is only good for 1 year or two years not for a few years. If you want to get back into driving eventually, you better keep that medical card current otherwise when it lapse, your CDL will be downgraded to 4-wheeler status.

I sure hope you have learned from this mess.

Honestly there’s not much to say unfortunately. If you’re lucky enough to get the DUI charge dropped you might have luck finding a SAP friendly employer but with the DUI you’re looking at most likely at least a few years of having to find other work. You picked a bad time to screw up. You’re most likely just going to have to do something else for a few years or so. With a DUI on your record from what I’ve heard from other drivers you’ll be lucky to find another driving job within even the next five to seven years especially with a drug test failure.
