Good Evening all!! I am the Wife of a Driver that was terminated end of March 2024. 27 years with the same Company! Anyhow. I'm asking.. BE NICE He has 33 + years of driving. Great record. However I've had to have 2 major Surgeries with a 1 year time frame. He was and has been worried about me! Last April 2023 he had a backing incident, nothing major 1 month later another backing issue, nothing major June or July 2023, he was backing out of a fuel island. Loves Tanker truck pulls by behind him, btw he got out and made sure no one was there.. He hit the middle of the tanker and put a hole in it. Tanker driver also came into the truck stop backwards. The termination, was BLACK ICE in Nebraska, he laid the truck over, the load was meat and it was saved as soon as the truck was set back up. His termination report states all the accidents even though 1 is falling off tomorrow. What Company or any Company gonna be willing to hire him?? I have sent an Email to FMSCA to request a hearing on the layover. I sent In 23 pages of Evidence to support that there was no weather in the area, he was headed to York Nebraska for the night. Please no snide comments, I've been on him since he got fired, but we have a mortgage and car payment and RV payment that has to be paid. 3 storage units but I have decided to sell off all my families Antiques that were handed down to me, only child. We have some cash, but it's getting lower by the minute. Any leads or help is appreciated. Reminder ... BE NICE. :)

23 pages of evidence... seriously? Waste of time.

Nothing short of full ownership will provide any hope of recovering from this.

I don't know if you live in an area where this would be feasible, but Sysco is always looking for route drivers and they will hire pretty much anyone from what I've heard.

Sharon, we've given you all the advice you need. You continue to ignore it. Your husband made a bad choice to move his truck so he could get a hot meal. He could have stayed in Lincoln, NE and prevented this from happening.

Quit trying to change the facts with all your so called evidence. The real evidence is a loaded truck laying on its side. That evidence is loud and clear. There's nothing in your 23 pages of nonsense that changes that.

We are not being snide or ugly. We are being truthful with you. It's the one thing you refuse to be with yourself. Own this accident. Admit responsibility. Face the consequences. That's your only hope of getting a job. Rollovers are very serious. Until you take it seriously, no one will take you seriously.

We were nice to you when you wrote before. I never answered because I would have taken you to task for being a helicopter wife who is making all sorts of excuses for him. If he feels the same way as you, making light of those backing incidents, then he's done for. All accidents/incidents are serious.

What does this have to do with the price of tea in China? It has no bearing on his accidents. If he was that worried about you that he was not concentrating, then he should have not been driving.

You probably won't see it because you are making light by saying "nothing major". However, two accidents within a month is serious. He was lucky to not have been terminated then.

Most fuel trucks go into a truck stop whatever way it takes for them to get to their underground tanks. Again, you are making excuses for your husband. Apparently, the hole he put in the tank was above any fuel line because then he would have been charged with a hazmat incident. In this case, probably both are to blame.

You don't know what happened to that meat load. More than likely, the receiver refused it and it got sold pennies on the dollar. I hauled containers of fresh beef and fresh pork to the Port of Oakland from NE, IA, MO, CO, KS and OK every week for 3 years. In the past couple years, the beef loads were valued at $250,000 to $500,000. We had a driver that was by Big Springs NE in a construction zone, when a Crete driver went through the cones and hit our guy head on, pushing him off the road into a tree. The trailer was not damaged and stayed upright. The receiver, a company in Japan, refused the load, which is their right to do so. So our company, had to turn around and find a place to buy it pennies on the dollar. This happened in October 2022. So this accident of your husband's was very costly and VERY serious.

His termination report states all the accidents even though 1 is falling off tomorrow. What Company or any Company gonna be willing to hire him??

When he had his accident in March, it was more than a month to when it was falling off. So why would you think that it would not be put on the report??!!

As for him getting hired again....not by any serious companies that look at DAC records. In this economy, companies are struggling to get loads and keep their drivers running and if there are any incidents, and there's an attitude with it, they are letting them go. My company just sent a message yesterday about attitudes and letting a driver go because he did not want to go to New Jersey with a load. So I'm not sure, because we have not heard from your husband, only you and you are not a driver I can tell, what his attitude is about the three backing incidents and the layover. If he's not making excuses or downplaying the three backing accidents, he might be able to find a company, either a 1099 or one who's scores with FMCSA aren't very good....but pay won't be very good. However, the layover will keep him from getting hired pretty much by even those companies because the insurance on him will skyrocket.

He needs to look for Class B type driving jobs. Your 23 page email that you sent to FMCSA will keep him from being looked at as a Class A driver. Companies, even second chance companies, will shy away from him as being a troublemaker, especially with all your excuses.

OMG! Are you for real??! The guys were more than polite, with no snide comments in the previous post. I can tell you're an only child! Your attitude is one of entitlement. Because you don't like what we have told you, you have bombarded us with facts that don't matter and then tell us to be nice. Lady, at 73 years old and still driving out here, I don't have to be nice to you. Now, if your husband has some questions, I would be happy to answer them just like the other guys have answered you. I presume you are showing him the comments. If he's not accepting responsibility for those accidents, then he's done in this business.

DAC:

Drive-A-Check Report

A truck drivers DAC report will contain detailed information about their job history of the last 10 years as a CDL driver (as required by the DOT).

It may also contain your criminal history, drug test results, DOT infractions and accident history. The program is strictly voluntary from a company standpoint, but most of the medium-to-large carriers will participate.

Most trucking companies use DAC reports as part of their hiring and background check process. It is extremely important that drivers verify that the information contained in it is correct, and have it fixed if it's not.

HOS:

Hours Of Service

HOS refers to the logbook hours of service regulations.

OWI:

Operating While Intoxicated

1st off, I have only prior wrote about the Black Ice incident. How DARE you say that my 23 + pages of Evidence is nothing. You have no clue what I have.. BY THE WAY, I AM A DRIVER, ALSO... I know SHOCKER.. I've driven since I was too young to have a License and I could only drive local with the Owner of the Company or my Father with me. You DONT KNOW how to be civil. I'm a dumb woman according to you that knows absolutely nothing!! WANNA BET ON THAT! I WILL be sending the MODS a screen shot and hoping they remove you And if your 72-73.. I KNOW your parents taught you if you have nothing good to say, DONT SAY IT.

Sharon the point is your husband made a choice to drive. We all have made similar choices and were fortunate nothing happened. With your husband's experienced he should've known that radar and 511 conditions aren't 100% accurate. In a time where getting hot food delivered directly to you, or having access to Uber/Lyft to get you somewhere with food it was just a poor decision to push it to York. Road conditions change all the time. There had to have been clues to the conditions changing that he ignored. So many accidents/incidents in a short time ESPECIALLY with his experience makes me suspect he's too suffering from complacent. From google AI when looking up complacency in Trucking:

Complacency is defined by the Merriam-Webster Dictionary as “self-satisfaction especially when accompanied by unawareness of actual dangers or deficiencies”. The unsafe acts (speeding, multiple lane changes, backing without looking, etc.) may be a result of drivers becoming complacent with their driving habits.

does that sound familiar? We're not dragging your husband for making a choice that he's likely made hundreds of times before to push it. What you're catching flak for trying to minimize the severity of the situations. Rather than taking responsibility you guys are trying to pass the blame. THAT is why he isn't able to land another job. Putting a truck on its side will always be a red flag. However, using excuses to pass the blame will be an even bigger red flag. It shows lack of concern and failure to learn from situations to prevent them from happening again. In his 33 years of experience he should know 511 apps aren't completely accurate all the time. His experience should've had him realize there's absolutely no reason to be doing 70 (or 75 if I remember orignal post correctly) when you're coming up on a storm. I live in Central IA and recall wind being a major problem with that storm in NE. Let's face it. He was going too fast for conditions and instead of ACCEPTING RESPONSIBILITY for that you guys are throwing all sorts of hail marys out there hoping something sticks. I understand the financial situation but it's the wrong way to go about it. I'm not sure what you suspect the FMCSA to do. Your husband laid a truck on its side. The company made a business decision to part ways. You can be fired at any time for any reason as long as it's not discrimination of a protected class. The ONLY way FMCSA would do anything is if your husband was FORCED to drive in those conditions and was ultimately fired for doing so, or refusing to drive in those conditions when they told him to.

Sharon, something that unfortunately needs to be looked at:

After driving for a couple decades without incident, we have 2 backing incidents, one of which into a fuel truck, extremely dangerous and an easily preventable roll over.

This shows a degradation in mental acuity, cognitive function and judgment along with loss of fine motor skills.

It's never easy to look at, but these are all indicators of degenerative cognitive illnesses such as alzhiemers, dimensia and stokes. Most loved ones, rather than seeking testing of this, retreat into denial over the possibility of these, especially as we age.

By your own accounts, something has changed in your husband. He's gone from a safe driver to one that has demonstrated a marked deterioration of safe judgment skills in a relatively short peroid. I know times are tough, but perhaps this should be looked at with the family doc. It may be unrelated incidents, and your husband is just distracted or burnt out, but why risk it. Many illnesses, if diagnosed early can be treated with much success.

Yes, I am shocked that you are a driver. If you have a current CDL , then you should know that your husband's accidents (3 backing at 30+ years experience) are serious. Accidents do happen, but drivers know how to accept responsibility. We don't know if he has or not. However, if as a driver yourself, you sure haven't.

Oh, I do know how to be civil. But I have no patience for a person who does not want to listen to the advice given. Actually, if you are a driver with a current CDL, I don't believe you would have accepted responsibility for this accident. All your comments have pointed to that.

Go ahead and report me to the mods. A couple have already seen my comment and they might remove me, but I don't think so because I really did not say anything that hasn't been said before by others.

Yep, born in 1951, and you don't know my upbringing or my parents. My five brothers, sister and I had a very bad upbringing and my mother was a witch with a B until the day she died. My dad wasn't any better.

I'm sure if Brett or any of the mods want to chastise me, they will send me an email or text message. What I said, however, was to the point and factual, which you don't seem to want to accept, which is fine.

CDL:
