HI, newby here and could really use some advice. Last winter at my old job I hurt my back and after about a week of not being able to get to sleep one of my coworkers suggested i try some pot. So along with advil and pot i was able to control the pain somewhat and get some sleep. I smoked from the middle of Dec- March 1st. for the first time in my life! Over the summer I decided to full fill my lifelong dream of becoming and OTR truck driver. Went to CDL school in August and graduated September 19th. Went to Orientation with Werner on Friday September 30. Long story short i failed my hair follicle test which was done with my body hair, {I shave my head}. I'm 5'10" and weigh about 265 and have the worst metabolisim ever so im starting to understand why i failed the test, it takes longer for the fat cells to release the thc. I still cant hardly believe i failed the test after almost 7 months of not smoking. Anyway, Werner told me that the were terminating my employment for Violating Company policy. Do you guys have any advice on what to do? I really want a job as an OTR truck driver.

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

OTR:

Over The Road

OTR driving normally means you'll be hauling freight to various customers throughout your company's hauling region. It often entails being gone from home for two to three weeks at a time.

As far as I know of, wait until you won't fail a test, be honest with your next potential employer and try again then. You may have already tried but if not ask Werner if you may apply again in the future once a follicle test will show you haven't had any THC in however long previous to employment.

I believe the hair follicle test is only a company test, and not considered a DOT test. I'm assuming you passed the urine test, which means you didn't fail a DOT drug test. Someone please correct Me if I'm wrong here. If I'm correct, you should still be able to find a company to hire you. I'm not sure if that would show up on a DAC report though, anyone else know?

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

DAC:

Drive-A-Check Report

A truck drivers DAC report will contain detailed information about their job history of the last 10 years as a CDL driver (as required by the DOT).

It may also contain your criminal history, drug test results, DOT infractions and accident history. The program is strictly voluntary from a company standpoint, but most of the medium-to-large carriers will participate.

Most trucking companies use DAC reports as part of their hiring and background check process. It is extremely important that drivers verify that the information contained in it is correct, and have it fixed if it's not.

People will correct me if I'm wrong but yeah I think your pretty screwed for the time being. It might only go on your DAC as a violation of company policy but the companies will talk unofficially. Your best bet would be to find a mom n pop that only does urine testing.

It's going to go on as a pre-employment drug test fail.

"Technically" it's NOT a DOT Pre-Employment Screen - which is still only urine.

What's really weird is - DOT screens are MANDATORY, only urines are approved for DOT screens, and many of these companies do ONLY HAIR.

So chances are that Werner didn't do BOTH HAIR AND URINE.

So I guess DOT is looking the other way (wink wink, nod nod, bobs yer uncle).

Not understanding how you threw a dirty hair, after not smoking for 7 months.

I guess we're going to have to up our recommendations here to 8-12 months.

Now - legalities and "grey areas".

Since this was NOT A DOT DRUG SCREEN - you could probably answer NO to the "have you ever failed a DOT Drug Screen" and not be lying.

Since it's going to show up on your DAC , then you are probably doubly "grey area screwed", because even though you weren't technically "employed" by Werner (because you aren't an employee, until you get past initial orientation) you are still going to show Werner on your DAC.

And because Werner is going to be CALLED as a previous employer - they will probably disclose to any prospective employer, which company policy you violated.

As other have said - keep applying, be honest and hope for the best.

Werner did do both urine and hair follicle tests. From what ive read body hair stays longer. Hairs were taken from the top of my shoulders.

OK - so at least this won't go down as a failed DOT screen.

Did they TELL YOU that the urine was a drug screen also?

Urines are used as part of the DOT physical - looking for sugar, blood and proteins in the urine (diabetes and kidney issue indicators).

You musta been puffing like in indian cheif prior to quitting - to go hot after 7 months.

They did say the urine test was part of the dot. Pass that with flying colors. Had to pass a dot physical and urine test the previous month in order to go thru school. Like i said before i only smoked for that 2 and a half months. Don't know enough about smoking but some nights i could get to sleep with 1 or 2 hits. Other nights my back was hurting so bad i would literally smoke myself into a stuper before i could get to sleep. At the end there before i quit i smoked everything i had left just to get rid of it, which was about an 1/8 of weed over the course of 3 or 4 days. I was being drug tested at the job i had and right before i started smoking i had to do a random in mid December which i obviously passed, i had another random in the first part of August which i passed. Just wished i wouldnt have done this and lost some sleep instead. Never in my life have i felt so much pain in my back thou. For 3 days i couldnt even get out of bed.

In your position I would talk to a lawyer. May be nothing they can do for you, but I would find out.
