I am not trying to argue but your condescension is beyond anything I have encountered. I know I should not submit this because it will continue but I will this one time.

Honesty is condescension?

Hey Man, I’m on your side. Your company is not advising you to do the right thing and risking a potential violation with a high price tag that you are responsible for.

BMI:

Body mass index (BMI)

BMI is a formula that uses weight and height to estimate body fat. For most people, BMI provides a reasonable estimate of body fat. The BMI's biggest weakness is that it doesn't consider individual factors such as bone or muscle mass. BMI may:

  • Underestimate body fat for older adults or other people with low muscle mass
  • Overestimate body fat for people who are very muscular and physically fit

It's quite common, especially for men, to fall into the "overweight" category if you happen to be stronger than average. If you're pretty strong but in good shape then pay no attention.

I may be wrong but would definitely have to fight them on it. We get done for the weekend and truck goes into sleeper berth but I go home. So no one is in the sleeper berth and what I do or where I sleep is none of the DOT's business as long as not doing anything illegal

If your logbook shows you doing something different from what you were doing, then you've done something illegal. So it is their business if you log what you're doing illegally. It would not be any of their business if you were doing things legally, so don't invite trouble.

Logbook:

A written or electronic record of a driver's duty status which must be maintained at all times. The driver records the amount of time spent driving, on-duty not driving, in the sleeper berth, or off duty. The enforcement of the Hours Of Service Rules (HOS) are based upon the entries put in a driver's logbook.

Sleeper Berth:

The portion of the tractor behind the seats which acts as the "living space" for the driver. It generally contains a bed (or bunk beds), cabinets, lights, temperature control knobs, and 12 volt plugs for power.

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

Well I just looked it up to be sure.

§395.30 ELD record submissions, edits, annotations, and data retention.

Using the certification function of the ELD, the driver must certify the driver's records by affirmatively selecting “Agree” immediately following a statement that reads, “I hereby certify that my data entries and my record of duty status for this 24-hour period are true and correct.” The driver must certify the record immediately after the final required entry has been made or corrected for the 24-hour period.

I have only ever gotten that message after being parked for 24 hours. Such as home time or shop. I would truly be running illegally had I only certified then.

Prime and the DOT officer they brought in to lecture us told us to edit ASAP and certify daily. With paper you need to record each change and the ELD does that. With paper you sign and certify each day and the ELD allows that.

SAP:

Substance Abuse Professional

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

Obviously, you would certify your day before leaving the truck for a reset or vacation. So when you return to your truck after a 34 or greater reset/time off, you would certify your days not in the truck before logging in to your current day?

You certify your logs everyday, even the days you're off. It'll just say off duty for the entire previous day(s).

My ELD requires me to certify any days I was off the truck before it will let me do anything. The message stays on the screen and refuses to allow me to type anything until I comply

Hmmmm interesting when we go home we totally log off QC or when goes in shop ....guess been lucky past year then by what I read here....

When I go on SB I stay there until my drivetime comes. Yeah albeit in n out of the bunk. Do log off n on duties fueling ,waiting to be loaded, etc. Only level 1 inspection I had early on, I wasn't driving so the DOT guy in NM only checked my co drivers QC logs and our permit book, and took both of our licenses. While he did his paperwork. Wasn't worried we did pass easily lol

Thank you! I figured the ELD would make you certify the back time before going forward, was Just curious

Also, thanks for the heads up with switching sleeper to off duty when hitting the bathroom or whatever on your 10 hr break. Never would have thought they would grab you in a truck lot and cite ya like that

Yep. If they want to be jerks...they can go through the codriver too. So if I am in sleeper but sitting up front talking. Guess who can get a ticket and not even be driving

Case in point now. After my shift last night went to SB (night drivin) co got us outta Florida here in Bama at 1st Loves swap out. Well I find I have 1 hour for a 34 reset. So I parked for an hour why waste it over a single hour lol
