On the way to work this morning i was driving on i69 were the speed limit is 65 but traffic usually does 75-80 i was cruising at 80 mph and as i came around the corner a state trooper was sitting there and pulled me over! I got a ticket for 81 in a 65! How will this affect current employment and future employment?

You absolutely need to hire an attorney to fight it. If convicted it will have lasting consequences. Not only is your ticket for 16 over but that counts as reckless or careless driving depending on your state. If you're convicted of 2 or "serious" infractions like speeding 15 over, reckless driving, following too close etc you lose your CDL for 60 days. Look at your company handbook. Some companies require you inform them if you receive any tickets (personal and company vehicles), others only require to be informed if you're convicted. We have a couple drivers that had excessive speeding tickets that the company isn't allowing them to drive for 1 year.

Other than this how is your driving record? Regardless, hire a lawyer. Most lawyers offer a free consultation to discuss the facts and go over pricing if you choose to hire them.

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

Operating While Intoxicated

OOS:

When a violation by either a driver or company is confirmed, an out-of-service order removes either the driver or the vehicle from the roadway until the violation is corrected.

Second on hiring an attorney, Immediately. See if you can get appearance waived and the ticket dismissed entirely. The results of having it on your record, even if not a conviction can be very large. I recently got one for 7 mph over, It cost me 680 plus 100 charitable contribution but got it completely dismissed, even the record of the stop. Well worth it.

25 over is reckless driving 16 is just a normal ticket that holds 4 points

Then consider yourself lucky. Many states (and companies) consider 15 mph reckless. if you're convicted of the 16 over and receive another of any of the things in the picture below in the next 3 year rolling period you'll lose your CDL for 60 days minimum.

As a professional driver you know better. You're held to a much higher standard than most of those other drivers speeding. Just because others were doing it doesn't make it right or safe. I'll keep my speed limit driving self in the right lane and let you guys do your thing. I much more prefer being employed and not dishing out a ton more in insurance costs just to save a couple minutes.

In many States, 15 mph over the speed limit is Recklless Driving. Listen to what Rob T. suggested you do. Also, just because everyone else was speeding 10-15 mph over the speed limit is no excuse for your doing so, especially as a professional driver. This will be an expensive lesson. Hopefully, you will learn from it. Good luck.

Even with a lawyer you will have a hard time getting this dismissed. But at least try to get it reduced. An attorney may be able to negotiate the speeding down to something less serious. I guess it depends on how good and well connected the attorney is. So ask around for a lawyer with a lot of experience in these traffic matters. Good luck, I know you must be bummed out right now. This too will pass.

I agree with all the others above, Ron. If it's a struggle to afford, we get that. Many attorneys WILL accept a payment plan.

The reason it doesn't totally matter that it's NOT Rec/Op in YOUR state, it sure may BE, to the next company you want to work for.

A CDL needs to be protected at ALL COSTS, mi mano. I've been married to a driver for 23 years...and never would I ever just let him 'pay' a citation like that, and/or take 4 points. He's had a successful and lucrative career, as a professional driver.

We even FOUGHT a seat belt ticket....and won. It was a BLACK seat belt over his BLACK Carharrt's jacket, in a BLACK Jeep. The officer followed him into the fuel station, and said he didn't have it on, and cited him. IN OUR POV! Security footage FROM the store, OBTAINED by the lawyer, obviously showed him untangling himself, from said seat belt.

It was worth the $250.00. It's also why many companies DO have HiViz seatbelts anymore; so similar things don't happen in a rig!
