Writing this for my son who is a Stevens driver. So here is the scenario:

Driving in California, he had to stop into a Commercial Vehicle Safety check site. They found the overhead lights on Truck and Trailer were not operational. They were when he last checked. Correct me if I am wrong, but I don't believe these lights have anything to do with safety? They wrote him up with some type of ticket or warning, not sure.

But can this be put on his DAC? It seems unfair to me.

He is currently with the truck stop repair facility. They determined the truck lights are ok. (I don't know how) However, the trailer overheads are still not working. They think it might be water related, considering the storms over the last day or two.

Again, question is can this event be put on his DAC?

Drive-A-Check Report

A truck drivers DAC report will contain detailed information about their job history of the last 10 years as a CDL driver (as required by the DOT).

It may also contain your criminal history, drug test results, DOT infractions and accident history. The program is strictly voluntary from a company standpoint, but most of the medium-to-large carriers will participate.

Most trucking companies use DAC reports as part of their hiring and background check process. It is extremely important that drivers verify that the information contained in it is correct, and have it fixed if it's not.

The lights let other drivers aware of the height, width and length of the vehicle. They're required to be operational by federal law.

They wrote him up with some type of ticket or warning, not sure.

This would go on his MVR and effect his CSA score.

But can this be put on his DAC?

Yes, but it probably won't. I'd be more concerned with the CSA score and the MVR.

An MVR is a report of your driving history, as reported from your state Department of Motor Vehicles. Information on this report may include Drivers License information, point history, violations, convictions, and license status on your driving record.

He will have an inspection report. He needs to get that to Stevens as soon as it is repaired. The company has to send it back to the state DOT within 15 days.

The DAC is the least of his problem. It will go on his CSA for 3 years and the company CSA for 2 years.

Depending what they found with the truck lights I would look at the electrical pig tail from the truck to the trailer, espically with the storms they had out there.

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

Many times, I found the pigtail loose in the socket, due to wear in trailers sockets. I'd wedge a toothpick or stir stick in the socket under the plug to make it work until it got fixed right......

Cali's been turnin' into a Nazi state year by year as long as I can remember.. Sooo glad I finally left there lol.

OOS:

When a violation by either a driver or company is confirmed, an out-of-service order removes either the driver or the vehicle from the roadway until the violation is corrected.

Raymond, there's no hard and fast rules about things being listed on a driver's DAC. The company can list violations if they want, but they aren't required. Oftentimes they don't ever put things on a driver's DAC until the driver decides to quit.

Others already pointed it out, but this will be listed as points on the CSA. He has a legal obligation to get that inspection form to his employer. The DAC is not what he needs to be concerned with.

This should be what is termed as a "fix it ticket". If he gets it repaired, all he needs is to go by a scale in the state, and get a full equipment check. If that's good to go, the inspector will sign off on it. The driver will send this paperwork to the company as being compliant again. Once the company signs their portion, it gets sent back to the California DMV. All is forgiven.

***All of the above hinges on what the officer checked on the citation form.***

Dm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

DMV:

Department of Motor Vehicles, Bureau of Motor Vehicles

The state agency that handles everything related to your driver's licences, including testing, issuance, transfers, and revocation.

Ok that is the inspection report. It shows no citation issued. Repair must be completed prior to his next dispatch and the inspection report with the mechanics signature must be sent back to CHP within 15 days.
