I just got my CLP as well….how screwed am I? Is there anywhere that would hire me with this?

CLP:

Commercial Learner's Permit

Before getting their CDL, commercial drivers will receive their commercial learner's permit (CLP) upon passing the written portion of the CDL exam. They will not have to retake the written exam to get their CDL.

You should go back, and re study the section that includes "Reckless driving."

I'd say that you are pretty hosed until you get some time between you and this citation. Like, 3 years hosed.

HOS:

Hours Of Service

HOS refers to the logbook hours of service regulations.

Hire a lawyer and take it to court. If it gets dismissed it never happened, if you're convicted you're screwed.

You should consult an attorney, but this is still going to cost you lots of money in the near future. Even if you get it reduced, it will likely be a huge red flag to a potential employer.

25 MPH over the speed limit is definitely not protecting your license for a potential livelihood.

Your problem involves the FMCSA anti-masking regulations.

FMCSA anti masking guide

CSA:

Compliance, Safety, Accountability (CSA)

The CSA is a Federal Motor Carrier Safety Administration (FMCSA) initiative to improve large truck and bus safety and ultimately reduce crashes, injuries, and fatalities that are related to commercial motor vehicle

FMCSA:

Federal Motor Carrier Safety Administration

The FMCSA was established within the Department of Transportation on January 1, 2000. Their primary mission is to prevent commercial motor vehicle-related fatalities and injuries.

What Does The FMCSA Do?

  • Commercial Drivers' Licenses
  • Data and Analysis
  • Regulatory Compliance and Enforcement
  • Research and Technology
  • Safety Assistance
  • Support and Information Sharing

Fm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

Wow, very intriguing to see how these regulations are written to stop people from cheating the system. embarrassed.gif

Thanks for sharing this Chief Brodie. Very enlightening.

People work the legal system because the system is systematically broken. It is my understanding that only a small percentage of cases actually go to trial because prosecutors want to avoid the time and costs. Cases are plea dealed.

I think it's both sides wanting to avoid the time and costs of trial. A defendant is looking at tens (if not a hundred) of thousands of dollars to go to trial. Some people will pay an attorney just to negotiate a plea deal with no intentions of going to trial. A public defender just wants the case over with so they'll encourage you to take whatever is offered.

Your comments about the legal system remind me of some old YouTube videos I used to hear that featured a lawyer that learned to specialize in beating traffic tickets. This is the same lawyer that went on to create a law firm that pretty much does nothing but traffic law around the country. I'd completely forgotten that this was even a thing. I'm not sure how good their services really are, but they've been around for several years, so must be doing fairly well overall.
