Tank transporters among hardest hit by COVID-19 freight downturn
We all laughed when the comment showed up a little while ago on our local NextDoor app, "Anybody else getting three weeks to the gallon?"
Frankly, at the Wickenhauser household we're doing even better than that. With one family member retired except for writing at home for Trucking Truth, one working full time now at home and the other finishing up her college semester online at home, our three vehicles just sit in the driveway collecting dust.
In fact, we have to remember to go out once in awhile and crank the engines just to keep things circulating properly.
The problem is that something that is funny to us is no laughing matter to the tank truck industry that is supposed to deliver fuel to the gas stations that we don't patronize anymore.
According to an article at Transport Topics, fuel can amount to half the products hauled by the tank truck industry. Some tank haulers are reporting significant decreases in revenue since the COVID-19 panic began – some reporting a 60 to 70 percent drop in revenue.
Besides fuel, however, liquid food products have dried up as a source of revenue for tank haulers. Most-noticed is a dramatic decrease in the need for milk haulers since schools and other large-quantity customers no longer have a need because of the orders to shelter at home.
Coffee chain Starbucks, which is a huge consumer of milk products, says stores experienced up to a 75 percent decline in April's revenue because of their commuter and business office customer base staying at home.
“We’re in a survival mode,” Dennis Nash, executive chairman of Kenan Advantage Group, a hauler of fuels and chemicals, told Transport Topics. “The country has come to a screeching halt. Our volumes have dropped in half. This is the worst I have seen in my career.”
For Kenan, the good start to the business year ended abruptly on March 12. The company has laid off workers from among its 8,500 employees and 1,500 owner-operators, but said they plan to bring them back after the crisis ends.
Another tank hauler, Steve Rush, CEO of Wharton, N.J.-based Carbon Express, told Transport Topics that despite the sharp revenue downturn Carbon has some accrued savings to see them through until the end of the crisis. But he does worry about those smaller one-to-five-unit fleets that don't have funds in reserve.
“We were a $20 million carrier when this hit," Rush told Transport Topics, "and the chances are we’ll probably come out half of that when this is done — as long as we come out. And we prepped ourselves to come out of it.”
Dan Furth, president of Arlington, Virgina.-based National Tank Truck Carriers, told Transport Topics that the tanker industry will come back strong once the lockdowns are lifted.
“As we’ve seen during hurricanes and other natural disasters, we have about a 48-hour supply of gasoline at your local gas station,” Furth told Transport Topics. “So when they start turning this economy on, you could have a run on those stations the minute they let people out of those houses.”
Former Arrow CEO released from prison early
James Douglas Pielsticker, the former CEO of Arrow Trucking who was sentenced to prison in 2015 for tax fraud, tax evasion and embezzlement, has been released from the federal prison in Fort Worth, Texas, as part of a COVID-19 prisoner release program.
He will remain on home confinement until his sentence is up in May 2021. He must still pay $22 million in restitution.
Pielsticker is remembered for his stranding of 900 of 1,400 Arrow drivers just a few days before Christmas in 2009, when the trucking firm closed down as a result of his fraudulent activities.
Many drivers were stranded on the road without pay and without working fuel cards to get themselves back to the home terminals.
Pielsticker reportedly used the millions of dollars that he embezzled from Arrow Trucking to finance lavish personal expenses like his 1,000-gues wedding and new cars like a Porsche, a Bentley and a Maserati.
Fleets may exclude not-preventable crashes from records under new FMCSA program
As everyone knows, having a crash on a fleet's or driver's record is the kiss of death. And it is especially galling when the crash was a not-preventable one.
To address that issue, the Federal Motor Carrier Safety Administration has announced a new Crash Preventability Determination Program where commercial carriers and individual drivers can have not-preventable crashes stricken from their records.
The way it will work is that fleets or drivers who were involved in a crash after August 1, 2019, and who believe the crash was not-preventable, can submit a Request for Data Review at the FMCSA's website DataQ page, to have the crash re-evaluated.
The request must include a copy of the police accident report and other supporting documents, photos, or videos.
To qualify as non-preventable, the crash must meet the following requirements:
- Struck in the Rear type of crash when the CMV was struck in the rear; or on the side at the rear.
- Wrong Direction or Illegal Turns type of crash when the CMV was struck by a motorist driving in the wrong direction; or by another motorist in a crash when a driver was operating in the wrong direction; or by a vehicle that was making a U-turn or illegal turn.
- Parked or Legally Stopped type of crash when the CMV was struck while legally stopped at a traffic control device (e.g., stop sign, red light or yield); or while parked, including while the vehicle was unattended.
- Failure of the other vehicle to Stop type of crash when the CMV was struck by a vehicle that did not stop or slow in traffic; or by a vehicle that failed to stop at a traffic control device.
- Under the Influence type of crash when the CMV was struck by an individual under the influence (or related violation, such as operating while intoxicated), according to the legal standard of the jurisdiction where the crash occurred; or by another motorist in a crash where an individual was under the influence (or related violation such as operating while intoxicated), according to the legal standard of the jurisdiction where the crash occurred.
- Medical Issues, Falling Asleep or Distracted Driving type of crash when the CMV was struck by a driver who experienced a medical issue which contributed to the crash; or by a driver who admitted falling asleep or admitted distracted driving (e.g., cellphone, GPS, passengers, other).
- Cargo/Equipment/Debris or Infrastructure Failure type of crash when the CMV was struck by cargo, equipment or debris (e.g., fallen rock, fallen trees, unidentifiable items in the road); or crash was a result of an infrastructure failure.
- Animal Strike type of crash when the CMV struck an animal.
- Suicide type of crash when the CMV struck an individual committing or attempting to commit suicide.
- Rare or Unusual type of crash when the CMV was involved in a crash type that seldom occurs and does not meet another eligible crash type (e.g., being struck by an airplane or skydiver or being struck by a deceased driver).
